Practice Area: Failure to Accommodate

The California Fair Employment & Housing Act (FEHA) and the federal Americans with Disability Act (ADA) require employers to provide “reasonable accommodation” to employees with known physical or mental disabilities. A “reasonable accommodation” may include making existing facilities readily accessible to and usable by individuals with a disability, job restructuring, part-time or modified work schedules, reassignment to a vacant position, time-off, and other similar measures. In each instance, an employer is required to meet with the employee and attempt to identify what measures can reasonably be taken to enable the employee to perform the essential functions of his or her job.

If you are an employee or business in need of help with an accommodation matter, please call us to discuss your situation at (626) 808-HELP (4357).
